Terms and Conditions
Effective date: 19 July 2026
These terms govern access to ShopPepe. By creating an account, applying to sell, listing a product, or placing an order, you agree to them and to our Privacy Policy. Returning users are asked to re-accept whenever we make a material update — see the changelog below.
What changed on 19 July 2026: added this version-tracked acceptance flow, clarified how complimentary or promotional seller subscription grants work, and added an explicit re-acceptance requirement for future material changes.
1. ShopPepe’s role
ShopPepe is a marketplace that helps independent buyers and sellers discover each other. Unless a listing clearly states otherwise, ShopPepe is not the seller, owner, manufacturer, delivery provider, or agent of listed products. The sales contract is between the buyer and the relevant seller.
Seller approval and listing moderation reduce risk but are not a guarantee of identity, quality, legality, availability, or performance. Users must still use reasonable care, particularly for in-person pickup and external payments.
2. Eligibility and accounts
- You must be at least 18 and able to enter a binding agreement.
- Provide accurate, current information and keep it updated.
- Keep login credentials confidential and notify support promptly of suspected compromise.
- One person may not impersonate another, create deceptive accounts, or transfer an account without approval.
- You are responsible for activity performed through your account unless caused by ShopPepe’s breach of duty.
3. Buyer terms
Check the product, price, option, pickup or delivery terms, and seller details before ordering. An order is a request until the seller accepts or begins fulfilment. Stock and prices may change before acceptance. Provide usable contact and delivery information.
Inspect goods safely and promptly. Raise a problem with the seller first, then contact ShopPepe support with the order and evidence. Returns, refunds, warranties, delivery charges, and exchanges are primarily governed by the seller’s disclosed terms and applicable consumer law. Nothing in these terms removes rights that cannot lawfully be excluded.
4. Seller terms
Sellers must pass ShopPepe’s application and approval process before using seller tools. ShopPepe may request identity, campus, business, or product evidence and may reject, suspend, or re-review an application where reasonably required for safety or compliance.
- Only list goods you are legally permitted and able to sell.
- Use truthful descriptions, original or authorised images, accurate prices, stock, variants, condition, pickup or delivery terms, and contact details.
- Do not manipulate reviews, promotions, analytics, availability, or order status.
- Protect buyer data and use it only for fulfilment, support, fraud prevention, and legal duties—not unrelated marketing.
- Handle orders, complaints, returns, taxes, permits, consumer obligations, and product safety responsibly.
- Pay any clearly disclosed seller subscription or promotion fee. Manual M-Pesa references remain pending until verified; never submit a false payment code.
New or edited products may require admin approval. Approval can be withdrawn if a listing becomes inaccurate, unsafe, prohibited, or unlawful.
ShopPepe may from time to time grant a seller complimentary or discounted access to a subscription plan (for example, a free trial period or a promotional upgrade). Such grants are offered at ShopPepe's discretion, apply only for the stated period, and can be modified, shortened, or withdrawn at any time. A promotional grant does not create an ongoing entitlement to that plan or its features once the stated period ends.
5. Payments and fulfilment
Current buyer payment and fulfilment arrangements may occur directly with sellers. ShopPepe does not hold buyer funds unless the checkout explicitly introduces a ShopPepe payment service. Never share a PIN, password, one-time code, or full payment credential. Confirm recipient details before sending money outside the platform.
Seller subscriptions and promotions may use manual M-Pesa verification. A submitted reference does not activate a service until approved. Fees already consumed may be non-refundable except where law or the stated plan requires otherwise.
6. Prohibited products and conduct
You may not use ShopPepe for illegal, stolen, counterfeit, dangerous, recalled, regulated-without-authorisation, sexually exploitative, hateful, fraudulent, or rights-infringing goods or activity. Malware, scraping that harms the service, credential theft, unauthorised access, security testing without written permission, harassment, spam, and attempts to bypass access controls are prohibited.
7. Content and intellectual property
You retain ownership of content you submit. You grant ShopPepe a non-exclusive, worldwide, royalty-free licence to host, reproduce, adapt for display, and show that content only as needed to operate, secure, promote, and improve the marketplace. You confirm that you have the rights needed to grant this licence.
The ShopPepe name, design, software, and original platform content may not be copied or exploited without permission, except as allowed by law.
8. Moderation, suspension, and termination
We may remove content, limit features, suspend, or close accounts where we reasonably believe these terms, law, safety, payment integrity, or another person’s rights are at risk. We may preserve evidence and cooperate with lawful investigations. You may stop using the service and request account deletion, subject to records we must retain.
9. Availability and liability
We aim to keep ShopPepe accurate and available, but the service may experience errors, maintenance, outages, or third-party failures. To the extent permitted by law, ShopPepe is not liable for indirect or consequential loss, seller conduct, external payments, off-platform communications, or products supplied by independent sellers.
Nothing in these terms excludes liability or consumer rights that Kenyan law does not permit us to exclude. Each user remains responsible for their own fraud, breach, negligence, unlawful conduct, and infringement.
10. Changes, governing law, and disputes
We may update these terms and will publish the new effective date. For a material change, a signed-in user must review and accept the updated terms and Privacy Policy before continuing to use the marketplace; the version you last accepted is recorded against your account. Kenyan law governs these terms. Please contact support first so we can try to resolve a dispute informally; unresolved disputes may be brought before a court or other competent body in Kenya.
